i didn't know exactly which forum to put this so if it needs to be moved, cool. my 05 xa got a hit and run pulled on it thursday night by a drunk driver. he ended up not having insurance so now i have to claim it on my insurance and then they're going to go after him for the money later. he hit the car so hard that it almost ended up against the curb when i park about a ft. away from it and forward into my wifes car. he hit it directly on the rear rim and rear quarter panel. my insurance company wants to fix it, but think that something is going to be wrong with the suspension and or frame with that kind of impact, cause i don't think the car is going to ever drive right anymore and i definately don't want to deal with ongoing problems with it down the road. so my question is, does anyone know if i have the legal right at all to say that i want the car totaled since i don't feel save driving in it anymore after that huge impact on a small car? thanks.

I have no advice for you since I know nothing about insurance, and it makes no sense to me, but all I can say is good luck. Hope it all works out for you!

yeah. i was looking at trading it in for an xb really soon, but i don't know if the dealership will even take it now that it has been in an accident. i'm not sure if that will keep it from been able to be sold as a certified used vehicle there. i'm going to talk to the dealers monday and find out. if thats the case, i'm going down the street to the district attorney and filing a lawsuit agaist the guy to pay off the car since its his problem.

find out how much your car is insured for. if you have damages about (usually) 70% of the cars value then total it. i just went through nightmare of a bodyshop experience after my tC got into an accident (rear suspension gone + lots of body damage) and after one month of waiting and arguing (fix it the way i want) they agreed to total it.
*they were going to fix it even though it could be a total loss. after serious consideration it seems like it's better to negotiate a total loss (be nice to your insurance adjuster) since your fixed car won't drive the same, wont look the same and will have lost value.
go to an expensive body shop approved by insurance since their estimates will be nice and high. gap insurance should take car of whatever $ you owe on your car. hope this helps.
