Read it, been doing a lot of research on it too. If you see the Reg 256 statement of fact form there is the option to gift, but...... right next to it says does not include vehicles traded between individuals. If we both do trade than it might be suspicious and is consider government fraud (deep dodo). The only legit way is to have 1 gifted and another buy a car for a low price for lower Use Tax (this is not necessarily illegal) because it is not really a trade... haha. Al of this seems like a big hassle right now, but I don't see any other way around the Use Tax....

Other ways to to avoid Use tax is to have my parents adopt trivecta or have him as my spouse haha so it would be considered transferred between family

about selling the car for 2grand because it needs a motor rebuild, would the DMV then change the title of the car to non-operational or something along those lines?

How about not using the word trade?
Just say you are gifting the car to each other.

Or gift the car to each other at different times to avoid suspicion?

Or gift it to someone else in your families so that no owner is gifting and receiving?

Yeah but I think it might be too suspect. Gifting the car at different times can cause problems like if im driving a car without the title being under my name and getting into an accident, it would just be a mess.

Thought about the family one too, but my family up north. My dad has a different last name so it is plausible.

Yea, lets call the DMV next week to find out for sure, as least as far as selling the car as non-operational goes. Or if theres any other way they didn't state online to switch titles.

Hmnnkay I just got off the phone with the DMV... seemed like the guy had an unsure answer. He just said put it as a sell and value at $0 and we shouldn't be taxed on it. I don't know how much I want to trust his word since he did not even know what a scion was.... Also cause he said "I need to go, we've been on the phone for too long", he spent 10 minutes searching up scion tc haha, i ha to give him my plate numbers for him to look it up cause he couldn't find it on kbb. I think I'm going to go in the DMV again haha

I just got back from the DMV, the lady spoke really soft and leaned towards me so no one would hear haha. She said put it has a gift and just put the gift value, they'll never know. Haha I don't know what to do anymore. She said if I really wanted the legit way, she gave me a USE tax clearance form and told me to call and ask for exemption. One guy told me it's taxable and hung up on me and I could not get ahold of any other district of the BOE (Board of Equalization).
