I was wondering...

As a minor, can I get in any type of trouble for accepting alcohol offered to me, in which I accept and drink? I am not talking at party's or anything like that, but for example we went to the Cirque Du Soleil show in Philly the other week and did the Tapis Rouge VIP thing. I was offered and drank five or six martinis and wine.

I am only 19 (well, 20 tomorrow ) and just curious about this all. I am constantly offered drinks anywhere I go and wonder if I put myself at risk just by accepting if I do (I never do at restaurants but will drink at events if offered).

Legally, the establishment/company would be responsible if I were to be caught or whatever, correct?

Going to Canada in july though in which I will legally experience the "legal" life prematurely (19 is legal!). Should be a great time

They would get fined and you would get an underage drinking ticket. They would be in more trouble. If they find out before any police are involved. They would more and likely kick you out without getting police involved to cover their ****. If you were to get caught afterwards by police and you told them you were served. They would still get a hefty fine.

yes. it's called underage drinking. If it was legal for you to accept an alcoholic drink under 21 with no penalties, the legal drinking age would be lower, and yes the establishment will ALSO get in trouble for not checking your ID

i've never heard of establishments or any places offering drinks to ppl who look under 25 w/o checking ID's first.. these places must have a pretty good legal team

I think he was wondering if the place that was serving him would press charges on him if they found out he was underage. Which they might, but if they didn't check your id. It would be hard for them not to get into trouble, too.

Either way your taking a risk, but in all honesty. The fine wouldn't be that for you. Atleast here it isn't. My friends was $200 or a little more. Basically a slap on the wrist.

I think you guys misunderstood my question!

I understand the general laws and all that. My question was simply,can a minor get in trouble if they accept alcohol if offered at say a local restaurant and never get ID'd prior. Could the minor be held responsible or would the fault be on the establishment for serving a minor, or both?

I was just curious about this... I don't care personally, but just wondering who becomes at fault here.

I think everybody understood the question and my previous statement still stands... Are you serious!

Of course you will get in trouble. Underage drinking is underage drinking regardless of where you got the alcohol. It is hard for me to believe that you are 20 years old and are asking this question, at some point common sense should kick in. I don't mean to sound harsh but seriously, come on dude.

I agree. You cant honestly not know the answer. Just because someone gave it to you doesnt mean you arent liable. If someone asks you to shoot them, guess what? Its still murder.
If a cop asks you to speed, guess what? Its still illegal.
If a 12 year old asks you to bone her, guess what? Its still rape.
Is there anything else common sense that you dont know?

Like will said, I hate to be rude, but if a 20 year old doesnt know something as simple as this, I am scared.

Sorry for not being "in the know" on alcohol laws as much as most everybody else, but was just a simple question I wanted clarified. I understand the basic understanding of the laws, but I really was not 100% sure on them which is why I decided to ask. Sorry to "bother" you guys with my question, but if you have nothing worth saying just don't say it.

You make it sound like I am stupid for just asking a simple question when all it needed was a simple answer. I don't drink which is why I was oblivious to the correct terms of the law. It's like jumping down the back of somebody trying to learn an oil change. To most everybody it may be easy and second nature to do, but as much as they may understand it, just want how to do it clarified before they attempt it. Same deal, in some way.

Oh well, thanks anyway.

Simply put.... if your not 21 regardless if they offer you alcohol. It's illegal...because in the end you know your real age. But also the fact they should at least be asking for ID.
