Default wrecked my tc need answers!!!

Hey guys i wrecked my tc some lady decided to turn in front of me while i was going 45-50 mph...(i think) it wasnt my fault clearly...and how she could have miss judged it is beyond me. But she is claiming i was speeding! which is not true and her insurance wants to check my car for a chip that tells me how fast i was going before the incident on that road. My insurance company says some cars do not have this. Does anyone know if this exists in a 08 scion tc!? If you guys want to see pictures i will upload some.

I'm pretty sure there is a chip to record such information.

i think there should be a chip for the scions because i heard my friend went back to the dealer and complained about something and they said it wasnt under warranty because he was racing or revving the engine too high. they should be able to check this. i think..?

everything is recorded in the ECU.

speed, rpms, etc.

they could go back to a certain time frame and see exactly what it was.

okay, from what i remember in a previous post, ECU records information for up to 5 seconds before a crash or something. speed, rpm, gear, and pedal position, maybe steering position too. but i think it only records when the air bag goes off because otherwise the car has no idea it was even in an accident.

now, here is the thing, and it varies from state to state, if you were speeding, then you can be found at fault because you were exceeding the posted limit, (we did an example like this in class, where even if you are just 1 mph over the speed limit, you are 100% at fault) it doesn't matter if you have the right of way. it is like if you were drunk and she pulls out in front of you, then you are found at fault because even though you have the right of way, you were illegally operating your vehicle.

now some states have what they call contributory negligence, i think california has this. but what means they will attribute a % of the damage to each party depending on how much they believe your negligence contributed to the incident.

now, if i were you, i would call your insurance company and have them look into what right her insurance company has to pry into your cars data log. they dont' want it to be your fault, so they should seriously look into whether or not her company has the right to see what happened.

so anyway, the police report should be on your side, and if you've driven your car for 5 seconds, i guess the information is cleared. or try resetting the ECU or whatever with the battery negative.

the Tc has a "black box" that records all of the vital data in the car, and they can check it. dude, if you're in any danger of getting a ticket or no insurance coverage you absolutely must, must, must get an attorney, there is no substitute. state and municipal legal systems are set up to do one thing-make the state money, and they will if you don't put up a fight. don't believe a word they say!!

it isn't there for reasons like this, it is actually there for toyota because they like to study what was happening in their cars before they crash.

that is actually kind of smart and a good way for toyota to improve their cars. I'm glad with have this little "black box" in our car.
