Well, the water was covering the curbing and I have the Tien S-Tecs so that didn't help any.
Everyone told me to leave it Short Ram but I just had to put the CAI on it. I'm a dumb-___.

SRI is a safer bet, this is the first instance I heard of someone hydro locking with a SRI. He could have had a leak somewhere around the fender.
Oh, you were dropped? Probably why... I am still kind of scared driving around when it floods my self. I live in Miami, floods here are no joke.

Even more so because it happened because you didnt have a bypass AND it was the persons' fault for driving thru it. Not to mention it would have never happened if it werent for the unbypassed CAI that is for "offroad use only"
witnesses and pictures arent going to do anything. They will probably tell you that you should have been more careful.

WRONG they are liable. b/c if they werent they would not have barricaded it off in the first place AFTER we drove through it. its a hazard. I have allready been in contact with the mall. I have a meeting with the GM tomorrow. When its pouring down and the road is FLOODED, it kinda makes it hard to see.
If I claim it on the insurance, will they total my car out with water damage???
oh yea and I am a chick!

We pulled the plugs and there was water on the pistons.. we tried to get some of it out but so far nothing has helps. we even tried manually turning it over and push starting it and popping the clutch.. doesnt work.. this sucks so bad.
Should I even bother calling Toyota? Or should I just buy a new motor myself?
My Options:
1. Call Toyota.
2. Claim Insurance.
3. Just fix it and build it..

If you have full insurance they will cover it but your premiums will sky rocket, as it will be considered your fault no matter what. When I was 16, I was trying to get home during the beginning of a hurricane and a gust of wind just pushed my little Nissan Sentra off the road, and caused me to crash.
It was my fault for putting my self in that situation, as it was your fault for installing a CAI and dropping your car. If you take the Mall to court, you would have to prove that those modifications played no role in the hydro-locking, which would be relatively difficult.
That's the reason cars never come stock with CAIs or almost everyone would hydro-lock at one point or another. I think you will end up replacing the engine yourself depending on the insurance you have.

Yeah, the Mall would be possibly liable IF the car was stock or the CAI had a Bypass Valve and your vehicle was damages because of a hazard on their property. It is kinda like people who sue stores because they slipped on their floor.
The problem is that you have a Cold Air Intake and I guess your car is lowered, therefore you have dramatically increased the likely hood that your car would succumb to hydro-locking.
Now, some insurance policies have coverage for mechanical failure for which you pay a deductible and repair your car. I have that on my policy, but I hope i never have to use it.
