but you need to act fast and track him down before he gets away.. if you get his infos he cant get a way then you have a case.. if you cant track him, no infos or anything thats a bigger problem right there

gave him a bill of sale with $0.00 showing as a gift
and you have a cancelled check
The guy prolly dosent even live in Florida.....

IT's a common thing to have the bill of sales as 0 or a very low price. I have done it as a gift, but I did a cash transaction, so I was safe.

Why on earth would you put $0 on the bill of sale!? So what if he had to pay taxes this is the USA we ALL have to pay taxes on basically everything. Sorry to tell you but you got SCREWED. Either you wait for the check to clear before handing over the car or a cash transaction.

Wow that sux! Rule of thumb when selling something big... ALWAYS wait until you are CERTAIN you have the money! If it's cash, wait til it is in your hand. If it's a check, money order, paypal, wait til it's visible in YOUR account for this very reason! Hope everything turns out well and you catch the *****!

I have done this before to help out a friend. I sold a 240sx and put that it was a gift. You have to pay a % in taxes of the total sale when you get it registered and transfer the title. If the amount is 0, then you pay 0 in taxes....but here in Texas, they have wised up and are now charging a minimum so they can atleast get something...sorry ____ers!

wow something out of the movies right there, Thing is this could have happened to almost anyone. Like people said if he conned you then chances are his contact info is fake, he might live in the same state as you. Your car is probably in pieces at this point your best shot if you can find the guy is go to court and hire a lawyer. Chances are whatever you end up doing it's going to take a long time to get your car back if you end up getting it back at all. Sorry.

Well I went to my bank today to find out how can I handle this situation. I talked with the Bank Manager and he told me that they released my title to me and the check was stopped that I deposited. He says that he never heard of a stop payment on a certified check. He called PFCU for me and got some more details on it. PFCU says that the buyer stated that the check was lost and they voided the check the buyer requested another check to be mailed to him overnight. It was a PFCU Pre-Approval Loan Check which could be used with any dealer or private party. They say its just like cash. PFCU also says we need to contact the buyer to get the new check they sent. Well we tried contacting him but still no answer. The bank manager says he would work with me if I needed anymore assitance. He adviced me to contact the authorities. I went to the police station and explained my situation and they said they cannot make a report because my car isnt stolen since I released my title. Next I contacted my insurance company and they said I cannot report my car stolen without a police report. Next I got in contact with a attorney. Unfortunatley he charged me a $170 fee up front for the first hour. I explained my story and he told me I am in a bad situation since the buyer has a BoS and Title, and Florida Gift Form. He said he wouldnt be able take the case, but he refered me to another attorney that will. He said that in order to even consider my case they would need a $200 per hour fee. I asked him should I contact the FBI and he says consult the other attorney first bc I need to act quick. So I will contact the other attorney on Monday. Also he mentioned I may have to contact a Miami attorney as well and fly down there asap.

Are for sure that the guy really lives in Florida.....sounds to me like you are gonna be running around trying to a find a mystery man........
I only see 2 things happening.
1. with him having the BoS as a gift and the title signed over to him, you pretty much are done and there is no way of getting your money or your car back.
2. Spending more money than the original sale of the vehicle trying to persue this.

If I were you, I would persue it though maybe in hopes of just finding the guy and removing his arms...I see that being worth 14g's.....Good luck!

what makes you think he lives in Florida? Find a way to force the buyers bank to give you his contact info it might be the real contact info, it might not. They must have more contact info about the buyer. If he walked into the bank....mug shot from camera.
