expedition vs. tC --- tC looses ::[TOTAL LOSS]::
all i was able to come home with (was at my aunt's house when it happened):
i'm finally getting over the shock and i'm pretty bummed about it
the dude lost control while making a u-turn. said the accelerator got stuck but also said that he hit the gas instead of the brake. he must've floored it as far as he launched my car. he was able to drive away w/ some tire rub against his front bumper that impaled my car. no one was hurt thankfully.
think it's totaled?

when a car gets totaled do i have the right to part it out? or does the insurance own it after they cut the check?

I don't think they will consider that totaled. The roof line is still in perfect shape. When the roof line is bent, that is when they will usually total it because they would have to replace the entire roof and areas supporting it which would cost a lot of money because the integrity of the safety of the car would be lost.
It also doesn't seem like there is going to be any frame damage either.
They will just need to replace :
Bumper cover
Rear lip
Rear 1/4 panel
1 wheel w/ tire and center cap
Axle work..looks bad, but isn't as bad as it seems.
possibly a new fuel tank (looks like fuel splashed out from the neck where you put the gas in except when you open the fuel door it may be separated a little)
They may use your tail light and buff out the marks.
You do not get the right to part it out if the insurance company cuts you a check in the case of it being totaled...but you don't have to worry about that in this case.

I really hate to see these types of pics. Specially cause I personally know all the hardass work you do to have this tC. All gone in blink of an eye.
I personally believe if I was in that situation...that person who hits me better run for the Canadian boarder before I get my lug nut wrench from the trunk. No one understands how much I work my ___ off for mine. Overtime, company required overtime including "We're going to make you stay another hour even if you're needed home within couple of minutes." I worked about six overtime weekends last year in a row including one weekend of whole week.

Wow, I feel bad for you. I know I'd be ____ed! I'm glad you're OK, and good luck regardless.
By the way, your back tires look really BALD, especially the passenger side. If I'm not mistaken, I see cords there in the next to last pic. For your safety (as well as others) please keep an eye on that in the future!

if theres frame damage then its totaled, but it doesnt look totaled.
you'll probably need a new rear suspension. depending on how expensive the stock stuff is, and if its not totaled you could take it to a cool body shop and get aftermarket stuff for it, maybe some coilovers if its needed how do yuo think i got my CF hatch

Look at it this way, A new set of rear shocks, which he will need, will run around $500. A new set of rear springs, which he will need, will run around $200. So the insurance company will give him $700 towards the rear suspensions for shocks and springs. What the Bodyshop purchases with that $700, is completely up to the shop and car owner.
You can get a set of coilovers for a tad over that, or he can have the shop cut him a check and he can buy the coilovers used.
I did this with my car.
Stock hood, $400 or so. Paint for it, $300 or so. The insurance payed $700 for the hood to the shop. Ship cut me a check for the hood, I bought a Kaminari revercowl, and had it delivered to the bodyshop, and they installed it as if installing the stock hood. NO INSURANCE FRAUD OCCURED.
Aftermarket parts are MUCH MUCH cheaper than stock parts.

I guess I was thinking only about Florida.... It's illegal in Florida to use aftermarket parts for insurance claims. Insurance companies fall under state regulations so it is different in some states.

Actually, in Florida you are allowed to use NON-oem parts. But there must be a disclosure statment made in the estimate stating this, and the consumer (person whos car is wrecked) has to agree to allowing it.
