i've never been in an accident, thankgawd. are you scared to drive sucha small car now? i wasn't even IN the tC when that expedition raped it and i'm already thinkin of goin bigger. maybe a lifted TITAN, altho i don't really go off road or haul anything. the tC fit me so nicely.

glad you caught the guy, tho, and that you lived to type about it!

My old car got rear ended and the guy pulled the same excuse out of his @ss - the gas pedal was stuck and he couldn't stop, so Mitsubishi (his car) had to pay me, not him, since it was a malfunction. But he was charged for going approx. 50mph in a 30mph zone and hit me at full impact and was over the legal limit so it worked out ok for me.

Good luck with your situation and yeah, get a lifted Titan. Girls who drive trucks are hot. Plus trucks never seem to get anything more than a scratch in an accident.

Malfunction or not he is driving and he is paying...........this is why people have insurance..........if he is trying to say he is not responsible due to a problem with the car and he continued to drive it knowing it had problems.........he is responsible.........

I went through this with a car I had that had a sticky throttle spring in the carb........i knew it was a problem and yet still continued to drive it............I got lucky and only flipped it 2.5 times in front of a state patrol while doing 90plus around a 30 mph corner........shocked the hell out of him..........

My own insurance came after me in court for driving it and sued me...........I lost........I had to pay for all my friends hospital bills in excess of $50,000............it was not a good year........I lost everything..........

So call your insurance everyday to get them on the ball and if needed call his every day to get them on the ball.........sorry to see your pretty car all crunched........

I had a similar (I'm using the world similar very loosely here) accident happened to me. I was driving out of the parking building where i work, and one of my co-workers back up just as I was going by. He hit me in my 1/4 panel, rear wheel, and bumper. Luckily it was low-speed stuff. My car is still drivable, but it the other person's insurance is gonna have to pay at lest $3200 for repairs. I'm really bumbed out about my car right now, so I kinda know how you feel. Everything looks like it's gonna work out for me, and I hope everything works out for you too giimmelub.

Also, the owner of the car is responsible for all maintenance. So if you failed to stop in time because your brake pads where gone, you're liable for everything. Same thing with the pedal thing the idiot who hit your car is claiming. He should've taken care of it, but he didn't, and chose to drive the car like that. He is 100% liable.

UPDATE:

i visited my tC in the bodyshop today. we went over the damages. other than what you can already see in the pics, the frame was rolled just a bit. they want to fix it. said it may take about a month.

so far estimated damages are in excess of $11,000.

i'm pushing for a total loss.


in other news my grand prix rental had expired tags and i got pulled over for it
enterprise rent-a-car=
no ticket thank goodness. exchanged it for a dodge avenger w/ the tire pressure indicator light on
