Default Bent my rims in a stupid construction zone yesterday(UPDATE)

So i was driving home on a back road by my house goin about 50 which is the speed limit there, and i forgot that they had started construcion, no signs nothing at all, and all of a sudden i hear a da dummppp i was like oh crap i think my tire hit the steel plate but i didnt think to much of it, but when i got home two of my rims were bent, one was bent enough to let the air out of the tire and it was flat, i went back and took pics of the site for insurance if they need them, what would you guys recommend doing in this situation.

I suffered something similar to you, but only my tires were damaged. You did good in getting pictures right away before anything changed, but go get some daylight pictures for god measure.

Also, see if your town reimburses for stuff like this. In Boston, they reimburse for these type of accidents but it may take awhile for you to get your money back. They might also not give you anything like with my case and blame it on the specific construction company doing the road work.

If all else fails, then try your insurance company.

And I almost bought those rims for my tC. But they looked to fragile in design, hence why they probably bent...

im about to go get some day pics but im afraid that they might have put up signs now, and anyways they remove the steel plates to work in the day time, im gonna try calling city, and then call my insurance

just wonderig why he would want to call insurance before city? if city pays for it, no need to involve insurance...

Personally, I would just feel better sending a claim through to the insurance company first.

I guess it doesn't matter.

My city would tell me to F**K off, so that is why I would just go straight to the insurance company.

i have my insurance with my uncle, but if i can i will avoid insurance all together and try to make city pay for it, just an update,

so today i park my car at the grocery store parking lot and go get some stuff for my mom, when i came back, maybe 20 minutes later i see that my fender was hit, looks like someone tried to back out of their spot and hit my car from turning to much and still being next to my car, so now i have 2 bent rims and need a new fender god this day is starting off to be so great

WOW. It's hard to tell because of the shadows, but it looks like that steel plate is like 3-4 inches above the bottom of the pothole. Definitely something I would take up with insurance or your municipality.

I believe in NYC, the city is only responsible for pothole damage if the pothole has already been reported. I guess once they are made aware of the problem, it's their responsibility to fix it. If no one has reported the problem, then your SOL. I think I read that somewhere, but I could be wrong. Dunno how the local laws are where you are but you can do some investigating to find out before deciding whether to file with your insurance company or the town.

Heh. If they are already working on the street (evidenced by the steel plates) they sure as Hell are 'aware.'

(The city should be involved with ANY work that tears up their streets - at the very least by permitting the work to be done. What you are looking at there, with the big pipe and steel plates, is a long-term project, not just dig a little hole and patch it all in one shift. Somebody should have a permit.)

Anyway, I'd try for the city, but keep in mind if the city says "no" it will probably be weeks or months away, and too late to report it to insurance, which is why someone else up above suggested reporting it to your insurance now. (My insurance requires that I report an accident or damage to my vehicle within 48 hours of my becoming aware of it, or they will automatically deny the claim.)

yeah im in the process of taking it up with the construction company doin the work, and tomorrow im gonna call up my insurance company to let them know what happened and what proper protocal would be.

hey update, im getting a check from the construction company, anyone know where i can get some drag dr17 wheels in gun metal for cheap?? I need to find out where i can get 2 replacments

FYI: there is specific state law helping the victim in these kind of situation. A forum i frequent had in depth discussion and user experience in these kind of situation. the bottom line is that if it was at the fault of the construction/road condition, the state or the construction company will be liable for the damage. (yes, you can take them to court even!)

there are some grey area where they can get out of it, but that's where its state dependent. and one last tip is talking to the construction company will probably be the easiest route, because they have insurance covering them for these kind of situation, so they pay up the easiest.

if anyone ever gets road damage to their car, don't pay out of pocket.

as for drag wheel, you can talk directly to drag.
