If you are not going to read the whole post just read the first paragraph and answer with the best of your knowledge.....plz

I got into a accident (8-26-04). It was @ a stop sign and it involved three cars. This was a very small accident, the only car that was damaged was mine . And the only reason my car was damaged was because the car behind me had a lisense plate holder with a nail ,which dented my rear bumper. I was at a two way stop waiting for the traffic to clear so I could continue north. I scooted out a but to get a better look at the intersection. I was just about to continue straight when I was hit. I got and and asked the chick that ran into me what happened. THE PROBLEM: The Mustang behind her jumped the gun and hit her which it turn made her hit me. WHO IS AT FAULT?? The Mustang or the Mercedes. Now if you want to know more continue reading...

IMPO the Mustang is @ fault, because if he did not hit the Mercedes there would not have been an acciedent. :? . I got out and he said with his own mouth that this was compleatly his fault and gave me is insurance info. I was not mean at all. I did not curse or anything. So... State Farm (f@#k them) called me and told me that the guys father wanted me to call him. So I had my mom give in a call. He said he did not tell SF to have us call him. The just wanted us to call him to so we could get into a verbal fight. . He said he had nothing to say except that he was not going to pay for the damage ($432). He said that his son told him that he did not hit my car. And that he did not see how his son could hit a Mercedes with enough force to hit my car a leave a dent when the other 2 cars were not scratched at all. That makes sense but there is the story

First of all he was not even there, he was supposedly quoting what his son told him. My mom was there and can argue against anything the father says because she was in the car with me. He was right that his son did not hit my car. His son hit the Mercedes, the car that hit me. Like I said before, if he did not jump the gun at the stop sign he would not have hit the Mercedes thus there being no accident. The son got out of his car and said "I am soo sorry for all of this, it is all my fault" that is the truth. He admitted to it and that girl herd it too. Second, the only reason there was no damage to the other cars was because there was no nail involed with their cars. There would have been no damage to my car if there was no nail on the license plate holder.. The son hit the Merecedes which made her jump and hit my car, its that simple. Also it takes alot to damage a 80's ventage Mercedes, and if a Mercedes hit the rear end of anything it would do damage. He did not hit the Mercedes that hard, just enough to startle her and make her run into me. So therefor she (The Mercedes) hit me at a faster speed than he hit her and also a Mercedes made in the 80's is heavier with that huge front bumper with a NAIL!!

Is there any law that can back my claim up, or what is your opinion

(The father also said the his son told him that my mom was giving him some attitude, my mom did not say ANYTHING, nothing at all. I did all the talking. ) Dont dis my mom

Update:
Heres the deal. I am getting tired about the fight, but I am not quitting. I am getting my car fixed on the 14th and will pay for it with my deductable. ($500). This may take a few months to sort out and will just have the person who is a fault pay me the money back. And may get some mods with the money :twisted:

Did you get the number of the women driving the MB? According to your statement she also heard him say that it was his fault. Your mom wont be that good of a witness since she is family. But the MB driver is.

I am getting her name and phone number tomorrow.. And am calling her ASAP, when I get it. She was crying and crap @ the scene and just took the guys info because he took the blame. This was my first accident ever @ 16 and didnt know what to do.... He said it was his fault and took his word for it. But I am calling her tomorrow.

From what i've been told before is that if a "chain reaction" accident like yours happens, you have to deal with the people that hit you and you cant deal directly with the person who caused the whole incident. From your story i would say its the Mercedes fault and you should deal with her. I find it sort of weird that a Mustang at a stop sign would have enough force to push any Mercedes into your car. Mercedes are like tanks and it seems sort of fishy that it got pushed into your car so easily

any state law states that when your front bumper hits someones rear bumper its the person who did the rear-ending's fault. I know this for fact because I rear-ended someone backing out of an on ramp and it was my fault by law. It sounds like the person that hit the person who hit you is at fault.

It doesnt matter if you began to take off and stopped or not. Its the person behind you's liability to make sure thier able to proceed.

Did you file a claim with State Farm? If so, let them work it out. But with the cost of the repair, maybe not.

Did you get the MBZ driver's info? Personally, if ins. isn't handling it, I would just try to go after her. Technically she is the one that damged your car. She'll have to fight it out with the mustang driver.

Yes I did. That is what my mom said, just let the insurance fight over it, someone has to pay.

I am getting the Mercedes info as soon as I can track down her number, i am waiting for some calls with that information, and will call her tomorrow or tonight if I can get by then.

From what I read is that the mustang hit the benz. This in turn scared the crap out of the chick in the benz & she probably un knowingly let off the brake right when it happend. So the force of the mustand + the engine idle forced the benz into his car. Thats what I got out of the story.

Chuck, I could not say it better myself . That is exactly what happened. Which is why I belive the Mustang is @ fault, but I am getting both cars info just incase.

same kinda thing happened to me...went through an intersection and so did the guy behind me but the light was changin so the guy behind him gunned it not realizin that traffic was stopped just past the intersection...3 car accident...the guy that hit me paid me and the guy that hit him paid him
if the girl can prove to her insurance company that the stang made her hit you then maybe his company will pay for it...i doubt it tho cause insurance companies are such pains

ALWAYS GET A POLICE REPORT! Then, people cant try to screw you later because trust me, they will try. The only time not to get one is if the driver wants to pay you for damages out of pocket right there on the spot.

Ouch. It sucks, I will make in companies fight over it, once I get in contact with that girl.. I am pretty sure that Mustang is going to pay. That girl is like a cat and she will not get screwed over. Belive that

YOU ARE SO RIGHT. I called my insurance after the fact and told me next time, since I am a youg driver to ALWAYS get a police report. Because they like to screw people over with lies. And that is exactly what that boy did. He went home and lied to his father because he did not want to get his car taken away, or get is trouble and is making the proplem ALOT bigger than it needs to be. I mean if you look and the dent it is less than 2cm across. But I am not just going to let that dent be there, b/c the car is one month old!

If I called the police it would have been another 30 mins, and everyone would have been late to class etc. At the moment it did not seem like it was necessary, but I def learned a lesson

The cop will say the MB driver faild to give enough room between the cars belive me if she was 50 feet behind you and some one hit her at 90MPH then she hit you his comment would be the same the MB driver faild to leave a safe distance between you and her.. her fault.. its crappy for the MB driver but her insurance co will go after the mustang driver for her money back...

Same thing happened to me. Its the fault of the person who first impacted another car, at least in pa. I was three cars ahead in an accident and i just got the check from the car who hit the car who hit me's insurance (sorry that doesnt make any sense)

It is crappy for the MB driver, but if a cop said that to me I would not agree with him. I does not matter how much space there was between the MB and my xB, there would not have been any problems unless the mustang hit her. You could always say there was not enought space inbetween the cars for just about any accident. I just dont think that is a valid excuse but then again I really do not care whos falt it is, I just need to collect .

I just called her, and no one is @ home . But I left a message and gave her munber to my insurance company and will let them deal with it from here.

Typically you have to go after the insurance company of the person that hit you. It's been that way ever since before I started driving ('87) and to my knowledge, has not changed.
