from my person experience when getting hit from behind at a total or close to complete stop even if you're just inching, I cant possibley FATHOM how it would be your fault Nathan, you didn't do anything cept for inch out, the people behind you need to pay attention and not jump th gun, when you approach the intersection...Simple traffic laws, its not liek you jammed your brakes but even then not your fault, people need to pay attention I would guess its the mustangs fault, or the person to the most rear of the accident but seeing as how the one with thw nail hit you they will be payin for your damage for following to closely,..

Your insurance company should handle it. If they don't you may be screwed. With no police report and no insurance company action your only choice might be to take them to small claims court if neither driver takes responsibility.
At least where I live, both of the other drivers would have been ticketed, (following too close, failure to yield or stop). A friend of mine was told that the police cannot determine blame or establish responsibility per say in an accident but the tickets can go a long way with the insurance companies in establishing the blame. Hopefully, your insurance company will go after the other drivers until one of them pays.

NOT YOUR FAULT,
Thanks BLeek. The problem is the that it is not my fault, just whether its the MB's or the Mustangs fault. My insurance has a $500 deductable, and the repairs only cots $431 (aka my LOWERING SPRINGS ) So I will pay for the repairs, but am going to stay on top of the problem and get my money back, not sure from who but probly will end up going to traffic court..

What makes you think it is too late to file a police report? You have the information from the other drivers don't you?

The striking vehicle is at fault - for you that is the Mercedes behind you. Now if she claims that the Mustang caused a chain reaction, then it is up to her to prove that.

Unless there is an expired statute of limitations to file a crash report in your state, I would go to the police department that has jurisdiction for the location of the crash and file a report. Let them sort out who is at fault.
