If they do not total it, look into diminished value. Insist on them doing you right.

The frame damage like someone else said should be the end of story, call insurance demand they total it, do not accept anything less. Your tires will wear funny and the box will never be the same I agree!!

The Honda dealership actually told me they would not be able to sell it on their lot because of the damage. Not exactly sure what they meant, maybe they will sell it at auction?..

I've calculated 17 MPG with the Taurus. I normally get about 26 in my xB. I've put about 3,000 miles on the Taurus. With the math, its about $220 difference. Pennies in perspective.

I talked to Toyota today, and they will not total it, well the adjuster who works for the insurance company said that... I was told that I will loose $3,000 on trade-in, and that I need to fight the insurance company for it. I went to talk to the Honda dealership (wanted a second opinion) and they offered to pay 10k for my xB on the spot. Apparently they wanted to sell a Civic LX badly.

My lawyer is saying the same thing everyone else has said thus far. No official word from the insurance company, and I don't expect one for a while. But the collision centre assured me that if I were to keep my car, that all their work would be covered for life.

I asked this question previously, but I'm going to ask it again. Is is strange that my brake system came from Canada? I'm wondering if they are using OEM parts on my car... But, there could be a warehouse up there. Just wondering if anyone knew.

I will dis agree here I used to manage a very good body shop... you don't always see all the damage until you tear a car down.....this hapens almost all the time it why they have supplements to cover unseen damage from the initial adjustment..this has no bearing on the quality of the shop

a supplement should not double the cost of the estimate! i would never trust a shop who's price had more than doubled from the original "estimate". granted it is an estimate, but any shop that could not get within 20% of the estimate is not a worthy shop(in my opinion)

depnds on the cost of the parts....as an example... you might have extra frame work that couldn't be seen or a sterring box that was cracked that could not be seen etc....I would be happier they found it..then missed it

Back to the mpg difference from the Taurus. I've driven Taurus's on trips and they get 29- 30 mpg's on the hwy.

Yeah, highway is pretty good on the Taurus. But, I live in the Ozark Mountains, and most of the miles are local.

In my state a vehicle is considered a total loss when the repair cost equals 75% of its value. At that point the law requires the insurance company to pay you that amount and take the vehicle. If you want to keep the vehicle, you must repair it to the full estimate. This is apparently to get severely damaged vehicles off the road and ensure they are either scrapped or properly repaired.

When your car is totalled, the insurance company certainly does not owe you a new vehicle! They owe you the value of the vehicle.

My '91 Mazda truck was totalled last year because the estimate of $2,500 was over 75% of its value of $2,700. It had been like new, only had rear end damage, and still drove perfectly so I wanted to keep it and fix it. I surrendered the plate and title to the DMV who then faxed my insurance company with proof, whereupon I was mailed a $2,700 check. The DMV issued me a Salvage title, meaning I owned a wreck. After repair, I took the bills and the truck to the DMV for inspection, and was issued a new license plate and a Rebuilt title, meaning I owned a vehicle whose repair had cost over 75% of its value. The truck is like new again, but worth less than before due to the Rebuilt title.

I kept the truck because it is a simple and tough vehicle, and the damage was minor. It takes significant damage to total an xB, the car is rather fragile, and repairs are not always so perfect. If my xB was totalled, I would put the settlement toward a new one.

I'm in your area (Fayetteville) and am picking up my new xB on Friday (From Fayetteville Auto Park = Landers no less). This is pretty scary to me...my first new car from a dealership that's being disreputable.

Well - if you see a brand new BSP xB here in a couple weeks it's me.

Best of luck with FAP/Landers. I hope I don't have the same experience.

Just a quick update. I talked to my lawyer yesterday; we agreed to fight for the lost value (3000), medical bills, and for inconvenience (x3 medical bills). We are also getting my car inspected by a third party when the repairs are complete. My plans are still to trade it in when everything is said and done.

Buying the car was a great experience, maintenance was a breeze, just, if you get hit, I would recommend "Signs" off 6th Street. I took my xB there when i was in a small fender bender last year, and it was fast and easy. Fayetteville/Landers Collision Center just has too many cars on their hands, and don't have time to dog the insurance companies like they should. I just can't wait till they finish remodeling the showroom.

I totaled my last car (hit a deer on the highway) and had it rebuilt. Gave me a TON of problems afterwards. Trade it and get a new xB.

I got my xB back yesterday. I drove it around, and it felt fine. I gave them the insurance check and they gave the car to me. The first thing I did was roll down my windows, as I always do, and my right rear window didn’t budge. So I drive back and let them know what was wrong. It was a small cross wiring problem. I then drove it to an inspector to make sure everything else was done correctly.

Here is the kicker, I get a call from the 3rd party inspector this morning, and he said I would want to come to the garage and look at "this" myself, while the xB was still on the lift. I get down there, and he points out the following

*Very poor welding job on the support beams of my trunk, didn't even notice till he pointed it out
*Back right quarter panel is buckled and overlaps the bumper
*Right taillight has gaps (you can stick a popsicle though some of them)
*The muffler pipe was bent, and has to be replaced
*The exhaust tip is recessed into the bumper, and isn’t sticking out as far as it should, and can burn the bumper
*Duct tape was used to keep my bumper in the right place (really)
*Shims wrapped in duct tape were used to push my bumper out to mask the fact that the frame was not rebuilt correctly. (big problem)
*He claims that Gorilla Glue was used as a sealant, instead of quality corking
*There were holes in my wheel well
*There were many gaps in the "corking"
*And screws were missing.

Tomorrow I get the professional estimate of the depreciated value due to the accident, and will hopefully recoup that from insurance, and get myself a new car.

Yeah.. The inspector called my lawyer directly, and he called the man in charge of my car at Fayetteville Auto Park, told him what was found at his garage, and told him that I would be awaiting a phone call (no call yet), and wanted the message forwarded to the adjuster, who should have totaled the car from the start. The insurance company was billed for just over 10k last Friday. The inspector and my lawyer worked themselves up into a little frenzy soooo, I have a feeling that this is far from over. And in four weeks I'm heading off to college, and am crossing my fingers that all this can be ironed out before orientation (bigger headache).

i just bought a camo xb that looks exactly like that one. Im in central arkansas. As soon as I saw this thread i thought to myself "____, I got this dudes wrecked scion". Thankfully you still have it. Anyway just saying whats up to another Arkansan and good luck getting this straightened out.

Crazy crazy. I just picked up my xB at Fayetteville Auto Park. What you're saying makes me want to not even let them do oil changes...much less any regular maintenance.

I'm actually starting my masters at the U of A this fall. Hope you're an entering Hog It's really a good school.

Don't get the Collision Center and the Toyota Dealership mixed. I've had a great experience with Toyota, and am getting my second xB from them soon. Service has always been quick and have had zero problems with them. The Collision Center is another story all together..

Another quick update. I got my first carwash today, and that is the first time water has hit my car since I got it back. While I was driving home, the RPM's dropped, accelerator wasn't doing anything, car started sputtering, and quit. I pulled over, let it rest for a while, then revved it for a while, then it everything was fine. I'm starting to think my car does not like water...
