my xB totalled in drunk driving accident PICS, PLEASE HELP!!

next car, get full coverage, liability is only when you have a POS old car that is only worth the gas in its tank, and you don't care if it gets totaled or stolen.
real shame too cause your box looked very nice.
yeah, sue her for anything she might have and hope for the best.

Wow, sorry about your situation.
I work for State Farm Insurance (California). Not much you could but sue. And unfortunately that might not get you too far. Maybe get you a little money, but that's just a slow process.
Next time at least get some Uninsured Motorist coverage.

Hey dude, I had a accident kinda like that one. You may not feel that your body is hurt but you would be surprised how you could feel in about a month. The muscle get inflamed and start to hurt. I say keep going to the doctor. I had a head on and ended up going to a chiropractor for about 6 months. The cop says you might not get anything but i would push for it, you cant just let her keep doing these kinda things. she took something from you, take it back. thats just my two cents

Any work that you've had done to the car in the past month or so should be reimbursed to you. Do you have any of the receipts for any of the mods? I don't know if you'll get anything but it's worth a shot.

Glad you're ok. That looked like one sweet box.
The police officer is probably right; you can sue, and probably win, but if she has no assets, there is nothing she can give you.
Talk to an attorney. A good one will work on contingency (take a percent of what you win, rather than charging you a flat fee upfront). If the attorney says don't bother suing...well, then don't bother suing.
And get more/better insurance next time.

Thats sucks! sorry bro.
I would still sue her, take absolutely everything
she's got, house, belongings, pennies in her pocket
whatever. its not like she'll need anything where
she's going.
in case you do start selling some stuff, as someone
suggested before, let me get dibs on interior pieces.

Best advice I can give you - keep in touch with the investigating officer and make sure you're at every one of the other driver's trials. Ask the prosecuting attorney for the opportunity to speak, and make sure you tell the court how this incident has affected you and what you think about her punishment. Trust me, it makes a difference for the court to hear from the victims in cases like this.
In any case, stay positive, and realize how fortunate you are to have walked away from an accident like that. And even if you're angry at the other driver, try to be grateful that she survived, too.

I just want to say... sue her no matter what and have ANY income she gets thats not already called for - given to you. You may be able to get tax returns and/or even the higher state payments Alaskan residents get from the state govt.
Do not just not try - even if its her tax returns for the next 5 yrs, its something!!!!!
I'm glad both people involved survived.

yea you should sue. atleast to take what drinking money she has left. j/k. but really like the other poster said you dont know how your body will feel in a month. go to the doctor get checked up to be sure. you should sue for damages and negligence. just because your insurance is going to cover it doesnt mean you wont be paying for it with rate increases.

First off, VERY glad you came out of that in one piece - your poor box did everything it could to protect you, and looks like it did a damned good job.
In detailing the worth of your vehicle to the insurance company, try to include the full retail cost of all mods, including professional installation.
Trying to sue someone with no net worth is usually a lost cause - even if the court were to award you a million dollars, getting it $0.25 a month for the next several millenia won't even pay for your time, trouble, and lawyer...
Be very cautious about signing papers with the insurance company. Once you say you are satisfied with their offer, that's it.
Also be sure you are physically OK.
Again, glad you came out of that in one piece!

Oh man, that plain sux. Without collision insurance, I think your only recourse is to sue; at least, that was the case when it happened to me.
A few years ago, my old clunker minivan got taken out by a drunk driver (hit on the street when no one was inside, thank goodness) and I got a judgement against him. He agreed to pay the book value for the van (I had only liability insurance on it) by making monthly payments. I got one payment and then he skipped town and I couldn't track him down. I did get part of the bail he had posted for another offence, but that was all . . . .
Anyway, I'm glad you're OK, and be sure to talk to a lawyer before you sign ANYTHING. Get someone who will work on a contingency basis so you don't pay until you collect what's due you. Good luck.
