Just waiting around, getting myself a rental and kicking back.
Will most likely end up selling the car and getting something different since I'm not a fan of water damaged cars. (if the insurance doesn't decide to just total it)

It's practically swimming in water. They might just replace the entire engine since it's an 09.
I'm still not keeping it. If they replace the engine I'm just going to try and sell it or just trade it in.

usually when the repairs exceed 70% of the value of the car, they deem it a total loss. they're probably trying to determine if there are recycled parts available for it. but there are two major downsides to where you're at.
1. is that you live in NY, you have to by law report when a vehicle has suffered a loss to the DMV,
2. it will go on the title as a flood damaged vehicle, killing resale value.
3. you should be entitled to the diminished value if you keep the vehicle.
4. if they do repair it and return it to you, you'll have no factory warranty on it.

1. i thought you were from new york, anyway, i know that you have to report accidents to the DMV, as for flood losses or comprehensive losses, not sure.
4. your warranty on the car is a factory warranty. toyota is telling you that they'll pay for repairs of any FACTORY defects on the vehicle. but factory warranty does not cover something when it was damaged by something else and then repaired. if they say, replace the engine, the engine itself will have a warranty since it is brand new from the factory, but you might not get a brand new engine, you might say, get a used or recycled engine because insurance companies have the rights to use recycles parts from other vehicles, so long as they're same model year or newer and in good usuable condition. they have the right to use aftermarket CAPA cerified parts as well.
and remember, your warranty is for everything, transmission, driveshafts, electronics, wiring ABS module etc. depending on where the water can get, it can damage short or corrode a lot of things.
i would argue that the car is a loss due to potentially unsafe liability to be reused on the street. even if the car becomes drivable again, the longevity of vehicle components submerged in water can be considerably shortened.

I do live in NY but I can't understand what kind of issue, a report to the DMV about a total loss vehicle, would impose.
Can I argue with the company on their decision to use a used engine (if they do) and am I eligible to remove all aftermarket parts? Granted I'll replace them with the OEM.
Can I refuse the repairs and just request a total loss due to the projected issues?
